Terms of Service

1. Agreement to Terms

By accessing or using ServiceMonitor ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users, including visitors, registered users, and paying customers.

2. Description of Service

ServiceMonitor provides uptime monitoring, status pages, and alerting for cloud infrastructure and web services. We monitor endpoints you configure, collect availability data, and notify you of incidents through your chosen channels.

3. Account Registration

To use the Service, you must create an account with a valid email address. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized access.

4. Acceptable Use

You agree not to:

  • Use the Service to monitor endpoints you do not own or have authorization to monitor
  • Attempt to probe, scan, or test the vulnerability of the Service infrastructure
  • Interfere with or disrupt the integrity or performance of the Service
  • Use the Service to transmit malicious code or conduct denial-of-service attacks
  • Resell, sublicense, or redistribute the Service without written consent
  • Violate any applicable laws or regulations in connection with your use of the Service

5. Payment and Billing

Paid plans are billed in advance on a monthly or annual basis through our payment processor, Stripe. All fees are non-refundable except as required by law. We may change pricing with 30 days' notice. If payment fails, we may suspend access to paid features after a reasonable grace period.

6. Free Trial

New accounts receive a 14-day free trial with access to paid features. At the end of the trial period, you must subscribe to a paid plan to continue using premium features. We reserve the right to modify or discontinue the free trial at any time.

7. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. The Service is provided "as is" and "as available." We are not liable for any damages resulting from Service downtime, including failure to detect or report an outage affecting your monitored endpoints.

8. Intellectual Property

The Service, including its design, code, logos, and documentation, is owned by ServiceMonitor and protected by intellectual property laws. Your use of the Service does not grant you ownership of any intellectual property rights in the Service or its content. You retain all rights to the data you provide to the Service.

9. Limitation of Liability

To the maximum extent permitted by law, ServiceMonitor and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Account Termination

You may close your account at any time from your account settings. We may suspend or terminate your account if you violate these Terms. Upon termination, your data will be deleted in accordance with our Privacy Policy. We will make reasonable efforts to allow you to export your data before deletion.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice within the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
